When you send an order by means of the On-line store for products and/or services your order shall constitute an offer for the products and/or services selected. We shall not be obliged to accept your order. If we do, your order may be accepted by us by means of an e-mail confirming the order sent to the e-mail address supplied with the order.

We reserve the right to decline any order for any reason, prior to the order being shipped. A contract or agreement for the products and/or services selected shall only be formed once our confirmation message is correctly sent to the address of your electronic mailbox on your Internet access provider's server. It is your responsibility to verify that your mailbox is in proper working order and you must assume the risk of all consequences for transmission or operational failures.

No orders shall be accepted if received from persons under the age of 18.

We accept payment by way of wire transfer, direct deposit, moneybookers or emocorp. Please refer to payment page for more details.

Delivery (Back to top)

All mobile phones are usually delivered via local express courier or fedex in view of the high value item. Our sales team will email customer with a tracking number as soon as the product is shipped. Shipping duration ranges from 3-7 days depending on the location of the customer.

In the event that Fedex or couriers return goods to us as undeliverable for any reason, additional delivery charges may apply to cover the cost of re-delivery. If orders are subsequently cancelled, any refund will have all delivery charges deducted from any refund amount given.

Customer is solely responsible for custom tax and other charges applicable to each shipment.

Returns / Refund Policy (Back to top)

In the unlikely event that goods need to be returned to us, it is imperative that a Return Policy is obtained first to enable us to process your return as quickly and efficiently as possible.

A return policy only effective for 7 days starting from the day the customer received the phone.

The condition of a return policy:

  1. The products is still factory sealed and unused. This include the box and all accessories that comes along.

  2. All shipping and insurance charges are bear by customers.

  3.  A restocking fee of 25% applies to the product bought exclude any other fee.

  4.  All other fee associated to the sales of the product will not be entitle for refund.

  5. The return of the products must be shipped by Fedex and a tracking number must be   provided to us within 3 working days once approved for return.

  6. The return of the products must be aprroved by us before sending back.

Failure to meet the above return policy, we will consider the product as sold. Losses arise from the agreed return terms will be fully bear by customer. Any additional charges arise must be fully paid to us before refunding is made.

Cancellation (Back to top)

Customers can cancel their orders for most items within 5 days of receipt of goods. Goods must be unopened and customers must take reasonable care of the goods while in their possession and both goods and packaging must be returned in resaleable condition. Shipping Fee to return the item to us are to be borne by the customer. Refunds will be processed within 30 days of receipt of returned goods subject to the condition of the item being received in good and resaleable condition. Please note that orders will only be considered cancelled once you have received confirmation from us, by email, that this has been done. A restocking fee of US$50 will be deducted from any refund for all cancelled and returned items.

All products purchased from this web site are covered by a 12 month limited warranty, in relation to defective materials or workmanship from the date that they are purchased from us, under which your products may be repaired free of charge by sending the product back to us for repair. Please note that the shipping fee incurred in sending the item to us for repair is to be borne by the customer.

For products covered with international warranty, please send to your local service center for repair/replacement by presenting the warranty card to them (this warranty card will be sent together with your shipment).

For products not covered with international warranty, please send to us by Fedex or DHL or other reliable shipping company for repair. Kindly note that buyer is solely liable for any shipment lost-in-transit.

Please allow up to 30 days for the product to be repaired or replaced.

All customers are by law responsible to pay duties and VAT in their respective country of residence.

If you have a complaint about our service, please let us know in writing. All complaints will be acknowledged within five working days. We will seek to resolve all complaints within 14 days and will keep you advised as to what is happening throughout the resolution process.




WARRANTY

All products sold through Porta Gadgets comes with a 12 Months Manufacturer Limited Warranty.

Porta Gadgets provides manufacturer limited warranty for all electronics sold through our web store unless specified. Porta Gadgets is solely involved in retailing of products of various brand name, all products come with warranty provided by respective brand names / manufacturer. Porta Gadgets acts as the agent to return any defective products to the original manufacturer for any warranty claims only.

We do not provide refund or exchange after the order has been shipped out. All returns of products for warranty claims are bear by customers such as shipping insurance and shipping cost.

Warranty Period (Back to top)

The warranty period starts at the time of Product's original purchase by the first end-user. The Product may consist of several different parts and different parts may be covered by a different warranty period (hereinafter "Warranty Period"). The different Warranty Periods are:

  1. Twelve (12) months for the electronics sold other than the consumable parts and accessories listed in (b) and (c) below;

  2. One (1) month for the following consumable and external parts and accessories:- battery, charger and handsfree kit.

  3. Other external parts and accessories such as keypad, keyboard, USB/Audio cables, covers, LCD screen and desk stands are not under warranty as they are external parts and are not under warranty by manufacturers.

  4. No warranty is provided for the media on which any software is provided,e.g. CD-rom, memory card. user manual.
As far as your national laws permit, the Warranty Period will not be extended or renewed or otherwise affected due to subsequent resale, repair or replacement of the Product. However, repaired part(s) will be warranted for the remainder of the original Warranty Period or for sixty (60) days from the date of repair, whichever is longer.

How to get manufacturer limited warranty service? (Back to top)

If you wish to make a claim under the Manufacturer Limited Warranty, you may Create a Support Ticket and provide details of faults or defects. Once your claims of defects is received, we will create an RMA, Fedex Airway bill for the product to be return to the Manufacturer for warranty claims. You must return your Product or the affected part (if it is not the entire Product) to us before the expiry of the Warranty Period.

When making a Limited Warranty claim you have to present:
  1. The Product (or affected part thereto)

  2. The legible and unmodified original proof of purchase, which clearly indicates the name and address of the seller, the date and place of purchase, the product type and the IMEI / Serial Number.

This Limited Warranty extends only to the original first end-user of the Product and is not assignable or transferable to any subsequent purchaser/end-user.

The Manufacturer may take a total of 1 month to repair and return the defective product.

What is not covered under Manufacturer Limited Warranty? (Back to top)

  1. This Limited Warranty does not cover user manuals or any third party software, settings, content, data or links, whether included/downloaded in the Product, whether included during instalment, assembly, shipping or at any other time in the delivery chain or otherwise and in any way acquired by you. To the extent permitted by applicable law(s), The Manufacturer does not warrant that any software will meet your requirements, will work in combination with any hardware or software applications provided by a third party, that the operation of the software will be uninterrupted or error free or that any defects in the software are correctable or will be corrected.

  2. This Limited Warranty does not cover:
    1. Normal wear and tear (including, without limitation, wear and tear of camera lenses, batteries or displays)
    2. Transport costs
    3. Defects caused by rough handling (including, without limitation, defects caused by sharp items, by bending, compressing or dropping, etc)
    4. Defects or damage caused by misuse of the Product, including use that is contrary to the instructions provided by The Manufacturer (e.g. as set out in the Product's user guide) and/or
    5. Other acts beyond the reasonable control of The Manufacturer.

  3. This Limited Warranty does not cover defects or alleged defects caused by the fact that the Product was used with, or connected to, a product, accessories, software and/or service not manufactured, supplied or authorised by The Manufacturer or was used otherwise than for its intended use. Defects can be caused by viruses from your or from a third party's unauthorised access to services, other accounts, computer systems or networks. This unauthorised access can take place through hacking, password-mining or through a variety of other means.

  4. This Limited Warranty does not cover defects caused by the fact that the battery has been short-circuited or by the fact that the seals of the battery enclosure or the cells are broken or show evidence of tampering or by the fact that the battery has been used in equipment other than those for which it has been specified.

  5. This Limited Warranty does not apply if the Product has been opened, modified or repaired by anyone other than an authorised service centre, if it is repaired using unauthorised spare parts or if the Product's serial number, the mobile accessory date code or the IMEI number has been removed, erased, defaced, altered or are illegible in any way and this shall be determined in the sole discretion of The Manufacturer.

  6. This Limited Warranty does not apply if the Product has been exposed to moisture, to dampness or to extreme thermal or environmental conditions or to rapid changes in such conditions, to corrosion, to oxidation, to spillage of food or liquid or to influence from chemical products.

Other important notices (Back to top)

For wireless devices such as mobile phone, PDA or any network related devices- A third party, independent operator provides the SIM card and cellular and/or other network or system on which the Product operates. Therefore, The manufacture will not accept responsibility under this warranty for the operation, availability, coverage, services or range of the cellular or other network or system. Before the Product can be repaired or replaced, the operator may need to unlock any SIM-lock or other lock that may have been added to lock the product to a specific network or operator. Accordingly, The Manufacturer does not accept responsibility for any delays in warranty repairs or for the inability of The Manufacturer to complete warranty repairs that are caused by the operator's delay or failure to unlock any SIM-lock or other lock.

Please remember to make back-up copies or keep written records of all important content and data stored in your Product, because content and data may be lost during repair or replacement of the Product. The Manufacturer, in a manner consistent with the provisions of the section entitled "Limitation of The Manufacturer's Liability" below, to the extent permitted by applicable law(s), shall not under any circumstances be liable, either expressly or impliedly, for any damages or losses of any kind whatsoever resulting from loss of, damage to, or corruption of, content or data during repair or replacement of the Product.

All parts of the Product or other equipment that The Manufacturer has replaced shall become the property of The Manufacturer. If the returned Product is found not to be covered by the terms and conditions of the Limited Warranty, The Manufacturer and its authorised service companies reserve the right to charge a handling fee. When repairing or replacing the Product, The Manufacturer may use products or parts that are new, equivalent to new or re-conditioned.

Your Product may contain country specific elements, including software. If the Product has been re-exported from its original destination country to another country, the Product may contain country specific elements that are not considered to be a defect under this Limited Warranty.

Limitation of Manufacturer's and Porta Gadgets's liability This Limited Warranty is your sole and exclusive remedy against The Manufacturer and The Manufacturer's sole and exclusive liability in respect of defects in your Product. However, this Limited Warranty shall neither exclude nor limit:
  1. Any of your legal (statutory) rights under the applicable national laws or
  2. Any of your rights against the seller of the Product.

This Limited Warranty replaces all other Manufacturer warranties and liabilities, whether oral, written, (non-mandatory) statutory, contractual, in tort or otherwise, including, without limitation, and where permitted by applicable law, any implied conditions, warranties or other terms as to satisfactory quality or fitness for purpose. To the extent permitted by applicable law(s) The Manufacturer does not assume any liability for loss of or damage to or corruption of data, for any loss of profit, loss of use of Products or functionality, loss of business, loss of contracts, loss of revenues or loss of anticipated savings, increased costs or expenses or for any indirect loss or damage, consequential loss or damage or special loss or damage. To the extent permitted by applicable law, The Manufacturer's liability shall be limited to the purchase value of the Product. The above limitations shall not apply to death or personal injury resulting from The Manufacturer's proven negligence.

NOTE! Your Product is a sophisticated electronic device. Porta Gadgets strongly encourages you to familiarize yourself with the user guide and instructions provided with and for the Product. Please also note that the Product might contain high precision displays, camera lenses and other such parts, which could be scratched or otherwise damaged if not handled very carefully.


Extended Warranty Policy (Back to top)

1. What is extended warranty? (Back to top)

Extended Warranty is a service offered by Portagadgets Australia at the time of purchasing that extends the Warranty period on selected hardware products up to a total of 3 years.

Extended Warranty provides for the repair or replacement of products if the product fails after the Manufacturer’s Warranty has expired.

The Extended Warranty Plan provides you with additional protection once your existing warranty plan expires. This option can be purchased upon ordering of the products which are not refundable or returnable.


2. Why should I purchase an extended warranty? (Back to top)

There are numerous benefits of extending your warranty:
  1. Total peace of mind where you are not liable for any shipping cost to return your faulty product (applicable to Extended Warranty Plus Options only). No labour cost to bear or even spart parts cost. Normal manufacturer warranty may not cover such minor items that will put a hole on your pocket.

  2. The plan is optional and is available on most products.

  3. Longer coverage period of more then the usual 12 months manufacturer warranty period. The plan provides complete parts and labour coverage with no hidden costs up to a total of 3 years.

  4. Your extended warranty can be claim anywhere in the world. This include even when you are travelling to overseas for a long period of time or you have migrated. As for the normal manufacturer warranty only cover locally.

  5. Guarantee Turnaround Time for return and repair service of not more then 45 days. Otherwise a new replacement will be sent out to you.

3. What is covered under extended warranty? (Back to top)

The Plan does not cover the cost of transport of the product, you can ship back the product to us using your own shipper or you can opt to use our courier company at discounted shipping cost. The shipping cost will be quoted on case to case basis depending on the weight and location of the product.

If we are unable to repair the products due to lack of availability of spare parts during these warranty period, replacement will be made with the same or an equivalent model based on its' current market value at the discretion of Portagadgets Australia. As a general guideline, we will replace you with products value as below:
  • If the products were sent back to us for repair during the first year of purchase, we will replace you with the same product or another product of similar value if we fail to repair the products economically;
  • If the products were sent back to us for repair during the second year of purchase, we will replace you with the same product or another product equivalent to 75% of the product value will be awarded if we fail to repair the products economically;
  • If the products were sent back to us for repair during the third year of purchase, we will replace you with the same product or another product equivalent to 50% of the product value will be awarded if we fail to repair the products economically.
Please note that the above replacement value is served as a general guideline only and we do not guarantee that such value will be honored as the replacement value will be dependable on the market value of the products that you purchased.

The Extended Warranty operates on the same terms & conditions as the Manufacturer's Warranty for the period of the extension. Our warranties generally cover parts and labor costs resulting from a mechanical or electrical failure of the camera caused by defects in workmanship and/or materials. Some parts however, such as the lens and LCD will be excluded. This warranty does not cover equipment which has been misused, tampered with, modified or damaged as a result of accident, water, grit, impact or lack of proper care as indicated in the manual of operations.
