These terms and conditions ("the Terms") govern the users ("you" or "your") use of the website www.portagadgets.com ("the Website") and your relationship with Liquidfunds Pte Ltd / Denzuke Network Sdn. Bhd. ("we", "our" or "us"). Please read them carefully as they affect your rights and liabilities under law. If you do not agree to these Terms, please do not access nor use the Website.

By accessing or using the Site, you agree to be bound by the terms and conditions below, and also agree to other policies in the website such as Privacy Policy, Return Policy, Shipping Policy and Manufacturer Limited Warranty Policy. PortaGadgets may modify this agreement at any time, and such modifications shall be effective immediately upon posting the modified agreement on the Site.

Information Does Not Represent Professional Advice

You acknowledge and agree that information published by PortaGadgets is intended to provide general information in summary form on legal and other issues. If any part of this agreement is held invalid, that part shall be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable. Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement. The laws governing this agreement will be the laws in Malaysia and you irrevocably submit to the exclusive jurisdiction of its Courts and its Appellate Courts and the jurisdiction of the Federal Court of Malaysia sitting in Putrajaya. For the purposes of this agreement the words "PortaGadgets", "We", "Our" and "Us" refer to PortaGadgets and "Site" to materials delivered on Portagadgets.com


Amendments

We reserve the right to: Update these Terms from time to time and any changes will be notified to you via a suitable announcement on the Website. It is your responsibility to check for such changes. The changes will apply to the use of the Website after we have given such announcement. If you do not wish to accept the new Terms you should not continue to use the Website. If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms; and

Modify or withdraw, temporarily or permanently, this Website and the material contained within (or any part) without notice to you and you confirm that we shall not be liable to you for any modification to or withdrawal of the Website or its contents.

Pricing

While we try to ensure that all details (including prices) displayed on this web site are correct and up to date, we cannot guarantee that they are. We do, however, update this web site as frequently as possible. You must ensure that, prior to placing an order, you have checked all relevant details about the products and/or services you have selected, as those may have changed since you last visited this web site.

All products and/or services displayed on this web site are subject to availability. We will advise you if a product or service is unavailable. All prices are subject to change at any time up to the time the order is shipped. If a price is corrected due to exceptional circumstances, we will inform you as soon as possible and provide you with the option of either cancelling the order or to continue with the order at the corrected price.

Products

All products we sell are brand new and original from the manufacturer. Kindly note that all products will be distributed directly from our oversea supplier which explained why we are able to sell the products at a much lower price compared to other online retail shops in UK. In view of the savings arising from the stocking cost as well as other handling fees, we are able to pass on the savings to you as our customer. Therefore, we wish to inform that we do not keep any stocks at our sales office due to the above reason. All orders must be entered via our website only, we do not take orders via phone or email.

Ordering

The information displayed on this web site, including prices, does not constitute an offer to contract or enter into an agreement.

When you send an order by means of the On-line store for products and/or services your order shall constitute an offer for the products and/or services selected. We shall not be obliged to accept your order. If we do, your order may be accepted by us by means of an e-mail confirming the order sent to the e-mail address supplied with the order.

We reserve the right to decline any order for any reason, prior to the order being shipped. A contract or agreement for the products and/or services selected shall only be formed once our confirmation message is correctly sent to the address of your electronic mailbox on your Internet access provider's server. It is your responsibility to verify that your mailbox is in proper working order and you must assume the risk of all consequences for transmission or operational failures.

No orders shall be accepted if received from persons under the age of 18.

Payment

We accept payment by way of local bank transfer, wire transfer, direct deposit, moneybookers, paypal, paymate or cheque deposits. Please refer to Payment Methods Page for more details.

Delivery

All mobile phones are usually delivered via fedex.com / ups.com / dhl.com or EMS in view of the high value item. Our sales team will email customer with a tracking number as soon as the product is shipped. Shipping duration ranges from 3-7 days depending on the location of the customer, customer clearance, public holidays and weekends or other unforeseen events.

In the event that Fedex or couriers return goods to us as undeliverable for any reason, additional delivery charges may apply to cover the cost of re-delivery. If orders are subsequently cancelled, any refund will have all delivery charges deducted from any refund amount given.

Customer is solely responsible for custom tax and duty and other charges applicable to each shipment.

Return Policy

Return Exceptions

Although we have a very flexible return policy on most of the items we sell, there are some exceptions.

The following items may not be returned.

  • Apple products
  • Consumables, including but not limited to recordable media, digital memory, batteries, paper, ink, ear phones, pouch, casing.
  • Software (after opened)
  • Back order items such as Fishing Reels, Watches and Contact Lens

Refunds

Refunds are applied to the payment method used at the time of purchase 5-10 working days after receipt of the returned merchandise. A full refund cannot be process if there are missing accessories. A refund cannot be process without an official receipt and RMA.

Exchange

If you purchased a product from PortaGadgets that you wish to exchange for an alternative, you can return the item for a refund (according to the title - Return Policy) and simply place a new order for the item you desire. We do not apply a refund credit to your new purchase.

We will send a product replacement after the Return Merchandise Authorisation (RMA) has completed our inspection process. The replacement will ship within 5 working days following our receipt of your return of goods. Please allow additional processing time after Holidays. Although it is our goal to ship a replacement as quickly as possible, we do not send replacements before we receive and inspect the returned merchandise.

Defective items in Transit / Dead on Arrival / Damaged items

PortaGadgets will normally check all items to ensure of working condition before shipping to you. However, there may be incidents that the item is defective when arrival.

An item that was discovered to be defective upon receipt can be replaced, or returned for a full refund. All charges regard to shipping and returning of the item is fully bear by Portagadgets. The reporting of Defective items in Transit or Dead on Arrival must be made within 3 days by contact us.

Return shipping

If an item is found faulty and falls under the warranty period, Portagadgets will bear the cost of returning the item back for warranty claims.

If a claim of faulty that does not falls under a manufacturer defects. The customer needs to bear the cost of shipping and associated charges such as cost of replacing the parts and workmanship.

In addition to our standard return policy, customer may requests for Door to Door Premium Pick Up service that will cost from AU$40 onwards to return the product. If the product weight more then 1kg, it will cost more according to the value and weight. Shipping insurance and packaging material are provided upon request from this premier pick up service.

Replacement

We will send a product replacement after the authorized return has completed our receiving/inspection process. The replacement will ship within 5-7 business days following our receipt of your return. Please allow additional processing time if there are incidents of holidays or back order of stocks. Although it is our goal to ship a replacement as quickly as possible, we do not send replacements before we receive and inspect the returned merchandise. To receive a replacement more quickly, you may place a new order for the same item (shipping not included), and we will issue a refund for the full value of the returned product (including shipping), upon completion of our return process.

Return Merchandise

Please contact us at / for a return merchandise authorization number (RMA #). If you do not have the return form, we will provide it to you together with your RMA number. Please fill in the requested information on our product return form, and carefully follow the instructions for return.

Returned merchandise must mean Return Policy conditions 

Remedies:

A consumer has a few options for remedies:

  1. refund in the form of payment made.
  2. replacement of the item / the supply of an equivalent item.
  3. repair of the goods or pay the cost of repair.

Cancellation

Customers can cancel their orders before the delivery of their order. Once the product has been shipped, the customer will bear all the cost of shipment and return. Cancellation of order is subject to return policy terms and condition.

If you have a complaint about our service, please let us know in writing an email to us at . All complaints will be acknowledged within five working days. We will seek to resolve all complaints within 14 working days and will keep you advised as to what is happening throughout the resolution process.

We make no representation or warranty of any kind, whether expressed or implied, including but not limited to, implied warranties of merchantability, non-infringement, or fitness for a particular purpose. All items purchased from our store are accompanied by a manufacturer warranty, unless indicated otherwise. You acknowledge that any warranty in connection with all products or services offered on our site is solely provided by the manufacturer or supplier of that product or service.
